If the disposable monthly income is less than £50 then no fee will be payable to the Tribunal.
Fee Reimbursements
An Employment Tribunal Judge will have the power to order unsuccessful parties to reimburse the successful party for any fees paid. However this is not automatic and orders are at the discretion of the judge.

*Disposable Monthly income is classed as:
Your Net income (income after tax, NI and pension contributions) and that of your partner MINUS any or all of the following:
- Housing Costs (Mortgage, Rent etc but NOT council tax or utility bills);
- Fixed allowances of Partner (if you’re part of a couple) (£159 a month);
- Dependent Children (Only if you have children) (£244 a month per child) and General Living Expenses (£315 a month)
- Child Maintenance;
- Child Care Expenses (nursery, pre and after school care or child minder. NOT school fees)
- Payments under a court order.
